Anthony Philpott 1987

Since returning to the bar, Anthony Philpott has shown versatility by appearing in a libel case in the Court of Appeal, in a property and trusts case before a Chancery Judge and in the Old Bailey for a defendant in a criminal trial. He is therefore at home in both the civil and criminal courts at the highest level.

Anthony is dual qualified as a solicitor and a barrister. He is registered as a Public Access Barrister and uses the skills of a solicitor in advising clients direct in suitable cases.

He was in house Legal Counsel with Bovis Lend Lease Limited a multinational project management and construction company for eleven years. He is published in the Legal 500 of leading lawyers in the UK.

He holds a BA Hons Law Degree and the MSc in Construction Law and Arbitration from King’s College University of London and he is a member of the Chartered Institute of Arbitrators.

He practised as a solicitor for sixteen years during which time he represented a Bank in property, consumer credit and mortgage repossession litigation. He prepared three reported cases in the Court of Appeal and conducted public housing and employment litigation.

He was called to the Bar in 1987 and prior to becoming a solicitor he practised as a barrister. He is therefore uniquely placed to combine the skills of both a solicitor and a barrister to offer a “one stop shop” of advice and representation to clients in many areas.

Commercial Property

During his time at Bovis Lend Lease he had sole responsibility for the company leases involving complex drafting and negotiation with specialist and leading commercial property law firms. He has dealt with the drafting and negotiation of head and sub-leases, negotiation and drafting of rent reviews, negotiation and drafting of break clauses, negotiation and drafting of variation agreements in respect of head and sub-leases, negotiation of dilapidations and termination of leases.  He negotiated and completed numerous commercial leases, site licences and lease agreements, in intense and demanding circumstances and within strict deadlines.

Construction disputes

 

He has significant experience of working within the construction industry and of the pressures on contractors, developers and clients. His extensive experience of resolving construction and engineering disputes including by way of Adjudication, ADR and litigation in all courts will enable him to try and resolve differences without recourse to Dispute Resolution so as to preserve working relations when instructed to do so.

Construction Contracts Procurement and Documentation

Anthony has significant experience of the Built Environment through the drafting and negotiation of contracts for and with employers, contractors, subcontractors and consultants with contract sums ranging from relatively small sums to tens and hundreds of millions of pounds.

Commercial Agreements

Anthony is experienced in working with an array of commercial agreements and has frequently undertaken contract drafting and negotiating on a range of commercial agreements.

When a disagreement arises as to interpretation of contractual arrangements Anthony is well positioned to provide an opinion on the likely effect of the contractual drafting and to assist in avoiding damaging and costly disputes.

Publications on Construction Law and ADR

Anthony has had two articles published in the International In House Counsel Journal in the last year, one on construction ADR and another on the conduct of litigation and Legal Professional Privilege.

He has written a number of articles on Construction Law that appear on the web site of Clarkslegal LLP Solicitors and on Employment Law that appear on the web site of Silver Shemmings LLP Solicitors.

Employment Law and Employment Tribunal representation

Anthony is an experienced Employment Tribunal advocate in all manner of employment claims and he prepares claims for individuals and the defence of claims on behalf of employers and personally represents them at the Tribunal hearings. He has up to date knowledge of employment law and had an article on ill-health and capability dismissals published in Tolley’s Employment Law Journal.
